1. Services Overview

Idaho Pro Digital provides:

• AI-assisted website design and build services
• Website hosting and related infrastructure
• Ongoing maintenance or support (if included in a plan)

All websites are built using automated and AI-assisted tools, sometimes combined with human review or configuration. You acknowledge and accept the inherent limitations of AI-generated content and code.

2. AI-Generated Website Disclaimer

You expressly acknowledge and agree that:

• Website builds may be partially or fully generated using artificial intelligence tools
• AI-generated output may contain errors, inaccuracies, security vulnerabilities, or non-compliant content
• Idaho Pro Digital does not guarantee: accessibility compliance (ADA/WCAG), legal or regulatory compliance, SEO rankings or traffic outcomes, or conversion rates or business performance

You are solely responsible for reviewing, testing, and approving all deliverables before public use.

3. Hosting Services & Usage Caps

3.1 Hosting Plans

Hosting services are subject to plan-based caps, which may include limits on bandwidth, storage, CPU or memory usage, monthly visits, API calls or AI usage, and build minutes or regeneration limits.

3.2 Overages

If your usage exceeds plan limits, services may be throttled, suspended, or limited. Additional fees may apply. Idaho Pro Digital is not responsible for downtime or performance issues caused by exceeding plan limits.

4. Client Responsibilities

You agree that you are solely responsible for all content you provide or approve, ensuring accuracy, legality, and ownership of content, compliance with applicable laws, and backups of your data unless explicitly included in your plan.

5. Intellectual Property

All proprietary tools, workflows, templates, AI prompts, systems, and processes remain the exclusive property of Idaho Pro Digital. Upon full payment, you receive a non-exclusive license to use the delivered website content for your business.

6. Third-Party Services

Your website may rely on third-party platforms. Idaho Pro Digital is not responsible for third-party outages, policy changes, pricing changes, or data loss caused by third parties.

7. Payments & Refunds

All fees are due as stated at checkout. Setup fees and AI build fees are non-refundable. Hosting fees are billed in advance. No refunds for partial months or unused services. Failure to pay may result in suspension or termination of services.

8. Suspension & Termination

We reserve the right to suspend or terminate services if you violate these Terms, fail to pay fees, your website is used for unlawful purposes, or your usage creates excessive strain on infrastructure. Upon termination, your website and data may be permanently deleted.

9. No Warranties

The services are provided "as is" and "as available." Idaho Pro Digital disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of AI-generated output.

10. Limitation of Liability

To the maximum extent permitted by law, Idaho Pro Digital shall not be liable for lost profits, lost data, business interruption, or indirect or consequential damages. Our total liability shall not exceed the amount paid by you in the preceding 3 months.

11. Indemnification

You agree to indemnify and hold harmless Idaho Pro Digital from any claims, damages, or expenses arising from your website content, your business activities, your use of the Services, or violations of law or third-party rights.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in Idaho state or federal courts.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Website or Services constitutes acceptance of the updated Terms.
